Declaring Surplus Specific Personal Property and Approving Private Sale Pursuant to NCGS 160A-267

 

WHEREAS, The County of Bladen owns seventeen (17) open top dumpster containers of varying sizes (6-yard and 8-yard containers) located at the Solid Waste Site, 1522 Mercer Mill Road, Elizabethtown;

WHEREAS, North Carolina General Statute §160A-267 permits the county to sell personal property by private sale;

THEREFORE, THE BLADEN COUNTY BOARD OF COMMISSIONERS RESOLVES THAT:

  1. The Board of Commissioners hereby declares surplus and authorizes the Interim County Manager to sell the following described personal property:

Seventeen (17) open top dumpster containers of varying sizes (6-yard and 8-yard containers)

  1. The County will accept negotiated private sale of the property for scrap metal pricing. 
  2. A notice summarizing the contents of the resolution or order shall be published once following adoption.
  3. The sale of this personal property by private sale will not be consummated until ten (10) days following publication.
  4. Surplus personal property is sold as-is, with no warranty.

Declaring Personal Property as Surplus and Authorizing Sale by Electronic Public Auction Pursuant to NCGS 160A-270 

Whereas, G.S. 160A-270 authorizes the Board of Commissioners to sell personal property at public auction, including electronic public auction, upon adoption of a resolution authorizing the appropriate official to dispose of the property at public auction subject to Board’s acceptance of the highest bid; 

Whereas, the Interim County Manager has recommended that the property listed on the attached Exhibit A and Exhibit B should be sold at public auction as surplus property; 

Now therefore, be it resolved, by the Bladen County Board of Commissioners that: 

The property described on Exhibit A and Exhibit B is to be deemed surplus property.

  1. The Interim County Manager or his designee is authorized to sell, by electronic auction at www.govdeals.com beginning on June 26, 2025at 8:30am, and ending on July 7, 2025, at 7:00pm, the surplus property described in Exhibit A.
  2. The Interim County Manager or his designee is authorized to sell, by electronic auction at www.govdeals.com beginning on June 26, 2025 at 8:30am and ending on July 14, 2025, at 7:00pm, the surplus property described in Exhibit B.
  3. The reserve price for the personal property is reflected on Exhibits A and B, with incremental bidding reflected on Exhibits A and B.  Property will be sold “As Is, Where Is”.
  4. Published notice of the sale solely by electronic means.
  5. A bid deposit is not required.  Payment in full must be made electronically through the GovDeals.comwebsite.  Upon final approval by the Bladen County Board of Commissioners, property will be transferred to successful buyer within 30 days. 
  6. The Interim County Manager, in accordance with State law, shall cause a summary of this resolution to be posted on bulletin board at Courthouse and place it on the County’s website.  After not less than ten (10) days from the date of publication, the Interim County Manager is authorized to sell the surplus property to the highest bidder.
